2.The petitioner, who has not surrendered on 22.06.2017 before the Judicial Magistrate for the alleged offences punishable under Section 394 IPC, in Crime No.6 of 2016 on the file of the respondent police, seeks anticipatory bail.
3.The learned counsel for the petitioner submitted that the petitioner was already on anticipatory bail. Subsequently, due to his non-appearance before the Court, the petitioner is apprehending of arrest.
4.The learned Government Advocate submitted that the petitioner has not surrendered before the Court.
5.Considering the facts and circumstances of the case and taking note of the fact that the petitioner has already got anticipatory bail, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on their appearance before the learned Magistrate concerned within a period of 10 days https://hcservices.ecourts.gov.in/hcservices/
from the date of receipt of a copy of this order, on executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate Court No.I, Kuzhithurai, Kanyakumari District or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m, for two weeks and thereafter, as and when required for interrogation.
