ORDER

The criminal original petition has been filed to direct the respondents to file a final report within the stipulated time in connection with Crime No.329 of 2017 on the file of the second respondent.

2.The case of the petitioner is that on 25.06.2017 at about 4.00 p.m., due to wordy quarrel, the petitioner and the first accused were abused in filthy language and attacked the defacto complainant with hands and legs. Hence, the defacto complainant lodged a complaint against the petitioner and two others. Based on the complaint, a case in Crime No.329 of 2017 has been registered. The further case of the petitioner is that he is working as daily wage driver and applied for heavy license instead of LMV License. Due to the pendency of this case, the RTO denied heavy license. Hence, the petitioner approached the second respondent on many occasions and tried to give the statements, but the second respondent did not care about the grievance of the petitioner. Hence, the petitioner filed this petition seeking aforesaid relief. 3.

When the matter is taken up for hearing, the learned Government Advocate (crl.side) submitted that based on the complaint given by the defacto complainant, investigation was conducted and the final report was filed as "mistake of fact" and the closure report was also submitted before the concerned Court and notice was also issued to the defacto complainant.

Crl.O.P.(MD)No.5515 of 2021 4.In view of the above submission, nothing survives for any direction in this petition. Accordingly, this Criminal Original Petition is closed.
