For Respondent : Mr.V.Neelakandan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.48 of 2015 on the file of the Respondent Police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 406 and 420 of I.P.C., in Crime No. 48 of 2015 on the file of the respondent police, seeks anticipatory bail.

3. The learned counsel for the petitioner submitted that the petitioner did not commit any offence as alleged by the prosecution and he is an innocent and he has been falsely implicated in the above said case.

4. The learned Additional Public Prosecutor appearing for the

CRL OP(MD). No.6536 of 2020 respondent police submitted that this is a second anticipatory bail application and the case has been registered in the year 2015 in crime No.48 of 2015 and the charge sheet was taken on file as C.C.No.117 of 2018 before the Judicial Magistrate, Ramanathapuram. The case was posted for appearance of the accused.

5. It is seen from the records that the petitioner has forged the signature of the defacto complainant, namely, the sister of the petitioner. He has withdrawn the amount of Rs.35,70,000/- from the bank, which has been sent by defacto complainant's husband, who is working in abroad.

6. Considering the specific allegation and number of years have been passed, this Court is not inclined to grant anticipatory bail.
