ORDER : The Court Made the following order :- The petitioners, who are apprehend arrest at the hands of the respondent police for the alleged offences under Sections 147, 148, 341, 294(b) and 307 of IPC in Crime No.327 of 2012 seek anticipatory bail.
2. The case of the prosecution is that due to previous motive, the petitioners and other accused persons attacked the de-facto complainant. Therefore, the de-facto complainant had lodged a complaint before the respondent police.
3. The learned counsel for the petitioners would submit that the co-accused were released on bail. He would further submit that the petitioners are innocent persons, they did not commit any offence and they are falsely implicated in this case.
4. The learned Government Advocate (Criminal side) submitted that he opposed to grant anticipatory bail to the petitioners. https://hcservices.ecourts.gov.in/hcservices/
5. Considering the facts and circumstances of the case and taking note of the fact that co-accused were released on bail, this Court is inclined to grant the relief of anticipatory bail to the petitioners.
6. Accordingly, the petitioners are ordered to be released on bail in the event of their arrest or on their appearance before the learned Judicial Magistrate concerned within a period of 10 days from the date of receipt of a copy of this order, on their executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only)each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Principal District Munsif Court cum Judicial Magistrate, Cheranmahadevi, or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioners shall appear before the Court concerned daily twice at 10.30 a.m and 5.00 p.m until further orders.
