O R D E R
This petition has been filed seeking to direct the 1st respondent to dispose of the petitioner's appeal dated 12.02.2025 pending on the file of the 1st respondent in his proceedings O.Mu.2998584/2025/D3 within the time stipulated by this Court.
2. The learned counsel appearing for the petitioner submitted that the land comprised in New Survey Nos. 58/15, 58/16, 58/17, and 58/18, measuring a total extent of 0.38.0 ares, situated at Agarapatti Village, Viralimalai Taluk, Pudukkottai District, originally belonged to the petitioner's father, who was in possession and peaceful enjoyment of the property until his demise on 14.11.2008. Thereafter, the petitioner has been in continuous possession and enjoyment of the said property. It was further submitted that the properties were purchased by the petitioner's father and his paternal uncle through sale deeds 2/5
dated 16.04.1961, 18.05.1961, 07.11.1968, 02.04.1973, and 16.06.1975. In such circumstances, respondents 3 and 4 have wrongly mutated the UDR patta in Patta No. 2177 in favour of persons who are strangers to the petitioner's property. Aggrieved by the same, the petitioner has preferred an appeal before the first respondent, which has been pending since 12.02.2025.
3. Heard the learned Additional Government Pleader appearing for the respondents 1 and 2.
4. Considering the above facts, the first respondent is directed to conduct an enquiry after issuing notice to the petitioner as well as the respondents 3 and 4 and thereafter. dispose of the appeal within a period of twelve weeks from the date of receipt of a copy of this order.
