ORDER

The petitioners seek to quash the impugned final report filed for the offences under Sections 420, 465, 466, 468 & 471 IPC. 1/4

2. The gist of the allegation is that A1 had made false representation to the defacto complainant and received a total sum of Rs.5 Lakhs and that he had directed the defacto complainant to deposit some portion of the amount into the account of the petitioners herein.

3. The learned counsel for the petitioners would submit that the petitioners had no direct contact with the defacto complainant and the defacto complainant has also stated that A2 and A3 had no role in the alleged cheating and that A2 in order to show his bonafides had paid a sum of Rs.3 Lakhs to the defacto complainant and that the parties have arrived at a compromise.

4. Admittedly, the petitioners and the second respondent have now entered into a compromise and decided to give a quietus to the entire dispute. The second respondent do not wish to pursue the case. The parties have filed a joint compromise memo dated 01.04.2025.

5. The petitioners and the defacto complainant are present before this Court in person. They are identified by Mr.S.Selvaraj, HC, DCB-I, 2/4

Madurai District. All the parties confirmed the compromise arrived at between them.

6. In view of the relationship and the above representation made, this Court is inclined to quash the impugned final report insofar as the petitioners alone is concerned. Accordingly, the Criminal Original Petition stands allowed and the impugned final report is hereby quashed insofar as the petitioners alone is concerned and the learned Judicial Magistrate No.I, Madurai, may proceed as against A1 in accordance with law. The joint compromise memo dated 01.04.2025, shall form part and parcel of the order. The petitioners shall pay a cost of Rs.10,000/- (Rupees Ten Thousand only) to the credit of the "District Siddha Medical Officer, CCRI, Periyakulam" (Account No.10767823177, IFSC Code: SBIN0000898, MICR Code: 625002601) and file a photocopy of the receipt along with a memo reporting compliance in the Registry. 12.11.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No LS 3/4
