ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Section 436 of IPC., in Crime No.145 of 2018, seek anticipatory bail.

2. The case of the prosecution is that on 23.04.2018, due to previous enmity, the petitioners set on fire to the petty shop belonged to the defacto complainant. The damage is worth about Rs.10,000/- Hence, the present case.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons, they have not committed any offence as alleged by the prosecution and they are no way connected with the alleged occurrence. He further submitted that the petitioners have been falsely implicated in this case. Hence, he prays for anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal Side) appearing for the respondent on instructions, would submit that the investigation is pending.

5.The learned counsel for the petitioners submitted that the petitioners are ready to deposit a sum of Rs.10,000/- to the credit of the crime number.

6.Considering the facts and circumstances of the case, this Court is inclined to grant the relief of anticipatory bail to the petitioners.

7. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Magistrate concerned within a period of 15 days from the date of receipt of a copy of this order, on their executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) each, with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Thanjavur or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioners shall appear before the respondent police daily at 10.30 a.m until further orders. The petitioners are directed to deposit a sum of Rs.10,000/- to the credit of Crime No.145 of 2018 on the file of the respondent police within a period of one week from the date of receipt of the copy of this order. However, it is made clear that if the petitioners fail to deposit the above said amount within the stipulated period, anticipatory bail granted shall stand automatically vacated without further reference to this Court.
