ORDER : The Court Made the following order :- The petitioners are apprehending arrest at the hands of the respondent police for the offence punishable under Sections 147, 148, 294(b), 323, 324 and 506(ii) IPC and Section 3 (1) of Tamil Nadu Public Property (Prevention of Damage & Loss) Act, 1992 and Section 4 of Tamil Nadu Prohibition of Management of Woman Act, 2002 in Crime No. 117 of 2018, seek anticipatory bail. 2.It appears that in connection with Pangu Peravai Election, the occurrence had occurred.
Counter case also registered in this regard. This Court already granted anticipatory bail to the accused in counter case in Crl.O.P.(MD)No.7976 of 2018, dated 16.05.2018. 3.Considering the nature of allegation made against the petitioners, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.I, Nagercoil, Kanyakumari District and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two common sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation.
The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
4.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
