ORDER
This writ petition has been filed seeking a direction to the respondents to make payment of eligible amount of medical reimbursement of a sum of Rs.3,58,397/- to the petitioner within a time frame.
2.Today, when the matter is taken up for hearing, the learned counsel appearing for ESI Corporation, on written instructions, submits that the claim of the petitioner is that his mother underwent cataract surgery in left eye at Shri Ramachandra Hospital, Madurai and claimed Rs.31,000/-. The Government has allowed eligible amount of Rs.9,703/- as per Central Government Health Scheme and disallowed a sum of Rs.21,297/-. Similarly, the petitioner's mother has also underwent cataract surgery in right eye at the same hospital and claimed Rs.21,000/-. The Government has allowed eligible amount of Rs.11,261/- as per Central Government Health Scheme and disallowed a sum of Rs.9,739/-. Therefore, according to the 3/7
learned counsel for ESI Corporation eligible amount was sanctioned for the treatment taken by the petitioner's mother. 3.The learned counsel appearing for the petitioner submits that without paying the actual amount suffered by the petitioner, they have disallowed certain amount and paid only a meager amount to the petitioner.
4.In reply, the learned counsel appearing for ESI Corporation submits that the petitioner is entitled for medical claim provided if he is taking treatment in ESI hospital. In the event if any specialised treatment is required, then, there must be a reference made from ESI hospital to the concerned hospital. In this case, the petitioner directly admitted in the private hospital and has taken treatment and made this onerous claim and therefore, the respondents have considered the petitioner's claim as per the Central Government Health Scheme and eligible amount has also been paid.

5.This Court has considered the submissions made on either side and perused the available records.
