ORDER

This Criminal Original Petition has been filed to direct the first respondent to file charge sheet in Crime No.86 of 2013 before the concerned Court.

2. The learned counsel for the petitioner submitted that the petitioner is a permanent resident of the address mentioned in the petition. Against him, the second respondent gave a complaint before the first respondent, as if, he had trespassed into the second respondent's land bearing plot Nos.4, 5, 6 comprised in Survey No.287/2A, 2C and also tried to encroach the properties and also threatened the second respondent with dire consequences. Based on his complaint, the respondent police registered the case in Cr.No.86 of 2013 for the offences under Sections 447, 324, 294(b) and 506(ii) of IPC. After registering the case, investigation has been conducted, but final report has not been filed so far. Hence, the petitioner filed this petition seeking to file the final report.

3. The learned Government Advocate (Crl.side) appearing for the first respondent police submitted that in this case, pertaining https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P(MD)No.6870 of 2022 to the complaint, investigation has been completed and final report has also been filed before the Judicial Magistrate, Paramakudi, but the final report yet to be taken on file by the Court.

4. I have considered the matter in the light of the submissions made by the parties.

5. Admittedly, the case has been registered against the petitioner in Cr.No.86 of 2013 for the offences under Sections 447, 324, 294(b) and 506(ii) of IPC. Further, the learned Government Advocate (Crl.side) for the first respondent submitted that final report has been filed before the learned Judicial Magistrate, Paramakudi.

6. In the light of the above submissions, the learned Judicial Magistrate, Paramakudi, is hereby directed to take the case on file, if it is in order , as expeditiously as possible.

7. With the above observation, this Criminal Original Petition stands disposed of.
