ORDER
(Judgment of the Court was delivered by N.SATHISH KUMAR, J.) The petitioner has sought for a Mandamus, directing the 3rd respondent to construct the western side compound wall at the actual western boundary of the Panchayat Union Elementary School at Veeranendhal Village, Thiruppuvanam Taluk, Sivagangai District in the light of the petitioner's representation dated 25.02.2026.
2. It is the grievance of the petitioner that only in order to facilitate the person who is residing near the school to use the pathway, an extent of 6.6. meters in width and 65.6 meters in length on the western side of the school has been left out for the purpose of road.
3. Learned counsel for the State, on instructions, would submit that the authorities have conducted survey as directed by this Court in W.P(MD)No.14860 of 2026 filed by one Jeyam, wherein, this Court by order dated 04.06.2026 has directed the authorities to conduct survey of the school building and the petitioner's property. He would further submit that the survey conducted reveals that about 2 cents of school property is encroached upon by the said Jeyam. The official respondents 3/7
have also filed the sketch relating to the subject property. In such a view of the matter, it is for the authorities to remove such encroachment as per law.

Learned counsel for the petitioner has also submitted that only in order to facilitate third parties to use the school property as road, compound wall has not been constructed by the school covering its entire extent. Whereas, the learned counsel for the State, on instructions from the 3rd respondent / BDO who is also present before this Court, would submit that compound wall will be constructed covering the four boundaries of the school not leaving any other land of the school and no piece of land of the school is left open for usage by any third parties.
5. Thus, recording the above submission made by the learned counsel for the State, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. [N.S.K., J.] & [M.J.R., J.] 15.06.2026 Index :Yes / No 4/7
