PRAYER :- For Bail in Crime No.851 of 2020 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner who was arrested on 04.03.2022 for the offences under Sections 454, 380, 302 @ 449, 392, 397 and 302 r/w 34 of IPC, in Cr.No.851 of 2020, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner along with the other accused persons trespassed into the defacto complainant's house and snatched the gold jewels from the defacto complainant's wife and also attacked her with aruval. Hence, the complaint. 3.The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submits that the petitioner has been falsely implicated in this case. 4.The learned Additional Public Prosecutor appearing for the respondent police submitted that the trial Court has already granted https://hcservices.ecourts.gov.in/hcservices/
bail to the petitioner. Since the petitioner did not complied with the bail conditions, the bail granted to the petitioner was cancelled. He further submitted that the investigation has already been completed and the charge sheet was filed and the same was taken on file in S.C.No.34 of 2021.
5. Considering the conduct and attitude of the petitioner and gravity of the offence alleged against the petitioner, this Court is not inclined to grant bail to the petitioner. Since the charge sheet was filed, the trial Court is directed to dispose of the case within a period of three months from the date of receipt of copy of this order.
With the above directions, this Criminal Original Petition is disposed of.
