For Respondent : Mr.V.Neelakandan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 5 of 2020 on the file of the respondent police ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 366 of IPC r/w.Sec.5(j)(jj) and 6 of POCSO Act, 2012 on the file of the respondent police, seeks anticipatory bail.

2 The case of the prosecution is that on 27.03.2020, one kokila who is the relative of the defacto complainant was kidnapped by the petitioner herein.

3. The learned counsel for the petitioner would submit that the petitioner and he has been falsely implicated in this case. He would also submit that both the petitioner and the victim are lovers and on the date of occurrence they ran away from the home.

4. The learned Additional Public Prosecutor would submit that the petitioner has only kidnapped the victim and now the victim has been secured.

5. Taking into consideration the nature and gravity of offence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Hence the petition stands dismissed.
