ORDER
The present petition is filed to quash the FIR in Crime No.308 of 2022, on
the file of the 1st respondent for the alleged offences under 147, 148, 294(b), 323, 324, 427, 452, 363, 506(ii) of IPC and section 4 of TNPHW Act, 2022.
2. The de facto complainants / respondents 2 and 3 are the son-in-law and the daughter of the petitioners herein.
3. The case of prosecution is that the complaint was given by the 2nd respondent alleging that the petitioners and their relatives attacked the respondents 2 and 3 and kidnapped the 3rd respondent. There was a quarrel between the relatives of the petitioners and the 3rd Respondent with regard to the money transaction. Hence on 22.07.2022 there was a scuffle between the relatives of the petitioners and the respondents 2 and 3.
4. The petitioners filed a petition for anticipatory bail in CRL.OP.(MD)No. 15155 of 2022 and the same was referred to mediation wherein a compromise was arrived at. Thereafter, the parties filed a joint compromise memo. In the joint compromise memo, the parties have agreed to resolve the issue amicably. The joint compromise memo, dated 15.11.2022, was executed by the parties in Tamil. The same has been recorded in the settlement memo granted by the Mediation Centre. In the said joint compromise memo, it is agreed that the petitioners and their
relatives will not interfere with the 2nd and 3rd respondents' family life, it was also agreed that the respondents would pay Rs.20,00,000/- to the petitioners in two installments, the first installment was payable on or before December 2022 and the second installment was payable on or before March 2023. The 3rd respondent agreed to execute a document in favour of the 2nd petitioner / father or any other person in respect of the property situated in Ganguvarpatty Village before December 2022. The respondent had agreed to say no objection if the petitioner in the case in Crl.OP(MD)No.15155 of 2022 to file a petition to quash the FIR. The respondents will not claim any right over the property and income of the petitioners.
5. Based on the aforesaid compromise the present quash petition is filed and the 2nd and 3rd respondents have no objection in quashing the FIR since the same has been agreed by the parties. Therefore, this Court is inclined to quash the impugned FIR based on the joint compromise filed in CRL OP(MD)No.15155 of 2022 and accordingly quashed.
6. At this juncture, the learned Counsel appearing for the petitioners / accused submitted that the respondents 2 and 3 have not paid the said amount as agreed in the joint compromise memo.
7. This Court is not inclined to entertain the said plea in the present petition. The petitioners/ accused are at liberty to exercise their rights to implement the joint compromise memo as per law.
8. With the above said observations, the impugned FIR is quashed and the criminal original petition is allowed.
