PRAYER:

Civil Revision Petition filed under Article 227 of Constitution of India to set aside the Docket order dated 05.04.2022 passed in S.R. No. 91 of 2022 in unnumbered Original Suit, on the file of District Munsif Cum Judicial Magistrate Court, Natham directing the Trial Court to taken on file the unnumbered Original Suit and proceed in accordance with law and thus render justice. ORDER

This Civil Revision Petition has been filed by the revision petitioner to set aside the Docket order dated 05.04.2022 passed in S.R. No. 91 of 2022 in unnumbered Original Suit, on the file of District Munsif Cum Judicial Magistrate Court, Natham and directing the Trial Court to number the unnumbered Original Suit. 2.Heard the learned counsel appearing for the petitioner and perused the materials available on record.

3.Perusal of case records show that the learned District Munsif Cum Judicial Magistrate Court, Natham has returned the S.R.No.91 of 2022, filed by the petitioner on three grounds. The first ground is regarding unregistered document, which can be decided at the time of trial. The other two grounds has to be rectified by the petitioner. 4.Accordingly, this Civil Revision Petition is allowed, thereby setting aside the Docket order dated 05.04.2022 passed in S.R. C.R.P(PD)(MD).No. 868 of 2022 91 of 2022 in unnumbered Original Suit, by the learned District Munsif Cum Judicial Magistrate, Natham. The learned District Munsif Cum Judicial Magistrate Court, Natham is hereby directed to number the suit, if the other two grounds of return are duly rectified by the petitioner. No costs.
