ORDER
The Writ Petition has been filed, praying for issuance of a Writ of Mandamus, to direct the first and second respondents to evaluate the Biology answer sheet of daughter of the petitioner and to provide 3 marks to the correct answer written by the daughter of the petitioner to the Question No-19 (gphpt[ - M) and consequently direct the third and fourth respondents to provide medical admission to the petitioner's daughter based on the marks.
2.Heard the learned Counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents. 3.When the matter is taken up for hearing, it is represented by the learned Additional Government Pleader, on instructions from the second respondent that two marks have been awarded for question No.19. 4.The learned Counsel for the petitioner, on instructions, submitted that the petitioner has accepted the two marks. However, he submitted that the case of the student shall be considered for participating in the counselling to get medical admission based on the total amended marks including the one now awarded. 5.Taking note of the submissions made by both sides, if the petitioner comes within the cut off marks, the case of the petitioner shall be considered, if otherwise the petitioner is eligible to be called for counselling.
6.With the above observations, the Writ Petition stands disposed of. Consequently, the connected Miscellaneous Petition is also closed. No costs.
