C-60.To Direct the Jail Superintendent, Central Prison, Palayamkottai to shift the petitioner/2nd appellant /A2 namely Inbaraj @ Edward Inbaraj, (M/40), S/o.Rasaiya Nadar who is confined in the Central Prison,

Palayamkottai, Tirunelveli District as a convicted prisoner (No.715826) to Tirunelveli Medical College Hospital High Ground, Tirunelveli, as inpatient pending disposal of the above Criminal Appeal.

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed for a direction to the Jail Superintendent, Central Prison, Palayamkottai, to shift the petitioner (Accused No.2) to the Tirunelveli Medical College Hospital for undergoing operation.

2. The petitioner underwent trial before the III Additional District Court, Tirunelveli for the charge under Section 302 of IPC. The petitioner was arrayed as Accused No.2. The trial Court, by judgment dated 07.11.2025, convicted the petitioner for the offence under Section 302 of IPC and imposed life sentence. Thereafter, he is undergoing sentence at Palayamkottai Central Jail.

3. The petitioner (Accused No.2) along with two other accused persons filed Crl.M.P.(MD).No.181 of 2026 seeking for suspension of sentence and this petition came to be dismissed vide order dated 12.02.2026.

4. The present petition has been moved on medical grounds and the petitioner wants to undergo an operation in a Government hospital. Considering the ground that was raised in this petition, we directed the learned Additional Public Prosecutor to get the medical report from the Prison and list the matter for hearing today.

5. When the matter was taken up for hearing today, the medical report submitted by the Dean, Tirunelveli Medical College Hospital was placed before the Court. It is seen that the petitioner is suffering from Hernia, which requires medical treatment.

6. Considering the same, we direct the Superintendent of Prison, Palayamkottai Central Prison to make arrangements for shifting the petitioner to Tirunelveli Medical College Hospital in order to enable the petitioner to undergo H-ernia operation. After the completion of the operation and after recovery, the petitioner can be shifted back to the Central Jail, Palayamkottai to undergo the sentence.
