ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 03.11.2017 for the alleged offences punishable under Sections 8(c) r/w.20(b)(ii) (c) and 25 of NDPS Act in Crime No.153 of 2017 on the file of the respondent police, seeks bail.

3. The case of the prosecution is that the petitioner and other accused in this case were found in possession of 150 kgs of Ganja and hence, the case has been registered.

4. The learned counsel for the petitioner submitted that the petitioner is an innocent person and a false case has been foisted against him.

5. The learned Government Advocate (Criminal side) submitted that the petitioner was found in joint possession of 150 Kgs of Ganja. He would further submit that the petitioner has not involved in any other case. However, he opposed to grant bail to the petitioner.

6. Considering the facts and circumstances of the case and also taking note of the period of incarceration of the petitioner, I am of the view that the petitioner could be enlarged on bail. https://hcservices.ecourts.gov.in/hcservices/

Accordingly, it is ordered that the petitioner shall be released on bail, on executing a separate bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Additional District Judge for Special Court for EC & NDPS Act cases, Madurai, and on further condition that the petitioner shall report before the Court concerned daily twice at 10.30 a.m. and 5.00 p.m., until further orders. sd/- 23/05/2018 / TRUE COPY / Sub-Assistant Registrar (C.S.)
