ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 to 4 apprehending arrest at the hands of the respondent police for the offences punishable under Sections 498(A), 506(i) IPC and Section 4 of Prohibition of Woman Harassment Act, on the file of the respondent police, seek anticipatory bail.
2.The first petitioner is the husband of the defacto complainant, while the others are the in laws. 3.The first petitioner undertakes before this Court that he shall pay a sum of Rs.3,000/- (Rupees Three Thousand only) as maintenance to the defacto complainant. The first petitioner shall deposit the said amount to the credit of Crime No.3 of 2018 on the file of the learned Judicial Magistrate No.II, Dindigul on or before 5th of every month commencing from July 2018. It is open to the defacto complainant to withdraw the said amount. If the defacto complainant furnishes her Bank details, instead of depositing the amount to the credit of crime number, the first petitioner shall remit the said amount to the credit of defacto complainant bank account. If these conditions are breached, this order shall stand vacated automatically as against the first petitioner. https://hcservices.ecourts.gov.in/hcservices/
4.The learned counsel for the petitioner, on instructions, submits that the first petitioner is now willing to live with the defacto complainant and the child of the first petitioner. Taking note of all these things, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions as set out above. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.II, Dindigul, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two common sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.30 a.m.
for a period of one week and thereafter as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. 5.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
