ORDER : The Court Made the following order :- The petitioner, who is arrayed as A4 was surrendered on 21.03.2018 before the learned Judicial Magistrate and he was remanded to judicial custody for the alleged offences punishable under sections 341, 307 IPC @ 341, 302, IPC @ 120(b), 147, 148, 341 and 302 IPC in connection with a case in Crime No.198 of 2018 on the file of the respondent police and hence seeks bail. 2.The case of the prosecution is that due to previous enmity, the petitioner along with the other accused attacked the deceased by using Aruval and sticks and there by caused his death. 3.

The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and that a false case has been foisted against the petitioner and based on the confession made by the co-accused, the petitioner was implicated in this case. It is further submitted that the petitioner is in jail from 21.03.2018 and hence, the petitioner may be released on bail. 4.The learned Government Advocate (Criminal side) appearing for the respondent submitted that in this case, the investigation is almost over.

5.Considering the facts and circumstances of the case and also considering the fact that the petitioner is in jail from 21.03.2018, this court is inclined to grant bail to the petitioner with certain conditions.

6.Accordingly, it is ordered that the petitioner shall be released on bail, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a likesum to the satisfaction of the learned Judicial Magistrate No.V, Madurai and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m and 5.00 p.m until further orders.
