PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying this Court to direct the 2nd respondent to issue non traceable certificate in respect of the document Viz., Original Sale deed in Document No.8814/2011 on the file of the Joint Sub Registrar No.II, Tirunelveli.

ORDER

The criminal original petition has been filed seeking a direction to the second respondent to issue non-traceable certificate in respect of the original sale deed in Document No.8814/2011 on the file of the Joint Sub Registrar No.II, Tirunelveli.

2.On 12.12.2011, the petitioner had purchased a property situated in S.No.967, 968, 969/1, 969/2, Karuvelankudu Street @ Kattalai Palla Street, Tirunelveli Town, from One Vasanthiammal through registered sale deed in Document No.8814/2011, on the file of the Joint Sub Registrar No.II, Tirunelveli. Unfortunately, on 04.04.2022 the petitioner has misplaced the said original sale deed near Vagaiyadi Mukku Bazar, Tirunelveli. On the very next day, he lodged a complaint, but the second respondent did not take any step in that regard. On 07.04.2022, the petitioner made a paper publication, but no one contacted him. Then, the petitioner has requested the second respondent to issue non traceable certificate. But, the second respondent is making the petitioner to run from pillar to post.

Crl.O.P.(MD) No.6916 of 2022 3.In view of the above, the petitioner is directed to issue a fresh paper publication and produce before the second respondent. On receipt of the same, the second respondent is directed to follow due procedure and issue non-traceable certificate to the petitioner within a period of two weeks from the date of issuance of paper publication. It is also made clear that the second respondent must ensure that the said document was not deposited by the petitioner for any other purpose.

4.With the above direction, the criminal original petition is disposed of.
