This Criminal Original Petition is filed to quash the First Information Report in Crime No.1345 of 2023 pending on the file of the first respondent police.
2.The case of the prosecution that the petitioner has posted a video comment as against the police officer for having initiated action as against him for the violation of Motor Vehicle Rules. Therefore, based on the complaint of the defacto complainant, a case has been registered in Crime No.1345 of 2023, as against the petitioner for the offence under Section 353, 506(i), 504 of IPC and Section 67 of the Information Technology (Amendment) Act, 2008.
3.The petitioner and his mother and the defacto complainant/the Sub-Inspector of Police, are present before this Court. The complainant, fairly submits that the petitioner is an young boy and he is also studying B.Sc., Computer Science and therefore, he is not interested in prosecuting the case, considering the future of the petitioner herein. The petitioner's mother also assured that the petitioner will not indulge in any 2/4
offence in future.
4.Considering the submission made by the petitioner's mother and also the concern of the defacto complainant, Sub-Inspector of Police, this Court is inclined to quash the FIR in Crime No.1345 of 2023. However, the petitioner is directed to donate ten chairs to the Government Rajaji Police Station, Madurai. Accordingly, the FIR in Crime No.1345 of 2023 of the file of the first respondent is hereby quashed. 5.This Court also place its appreciation for the attire and also the discipline of Mr.S.Sudhara Mahalingam, Sub-Inspector of Police, Madurai.
6.In fine, this Criminal Original Petition stands allowed. Consequently, connected miscellaneous petition is closed. NCC : Yes/No 22.07.2024 Index : Yes/No Internet:Yes jbr 3/4
