ORDER: The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 03.01.2026 on execution of NBW issued by the II Additional District and sessions Court, Thoothukudi in S.C.No.202 of 2025, dated 12.08.2025, for the offences punishable under Sections 294(b), 352, 506(ii) of IPC and Section 1/4

25(1-A) Arms Act, in Crime No.226 of 2024, on the file of the respondent police, seek bail.

2.The petitioner said to have committed the above said offence in Crime No.226 of 2024. Thereafter, it was taken on file in S.C.No.202 of 2025 on the file of the learned II Additional District and Sessions Judge, Thoothukudi. Thereafter, he regularly appeared before the Sessions Court in the above said case. When the case was posed on 12.08.2025, the petitioner said to have involved in another case. Hence, he was arrested without producing the PT warrant. He was not produced before the trial Court on the date of hearing. Hence, the NBW issued against the petitioner. Hence, the learned counsel for the petitioner submitted that in view of the arrest in another case, he was not appeared before the trial Court. Hence, he was arrested in this case under NBW. He is confined from 03.01.2026 onwards. Hence, this petition has been filed seeking bail to the petitioner.

3.The learned Additional Public Prosecutor would submit that there are 17 previous cases pending against the petitioner. Out of which six cases are pending trial.

4.In view of the above pendency of trial the presence of petitioner is 2/4

necessary in all the cases to complete the trial. Hence, this court is not inclined to grant bail to the petitioner for the present. However, the petitioner is at liberty to file bail petition before this Court after examination of material witnesses in all cases.
