PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, to issue suitable direction to the 2nd Respondent herein not to harass the petitioner and his family members on the guise of the enquiry based on the Representation dated 03.03.2026 given by the Petitioner. ORDER

The present petition has been filed seeking a direction as against the second respondent not to harass the petitioner and his family members under the guise of enquiry based upon his representation dated 03.03.2026.

2. According to the learned Government Advocate(crl.side) appearing for the respondents, the petitioner has been implicated in a criminal case in crime No.210 of 2025, which has culminated in filing of a charge sheet in Spl.S.C.No. 103 of 2025 and the same is pending before the POCSO Court, Sivagangai, and the next date of hearing is 24.03.2026.

3. The learned Government Advocate(crl.side) appearing for the respondents further submitted that due to the election, the petitioner is kept under surveillance, invoking the provisions of Section 126 of BNSS and therefore, no harassment is being caused to the petitioner.

4. In view of the above said facts, it is clear that the petitioner is only kept under surveillance due to his involvement in the alleged criminal case and therefore, there shall be a direction to the respondents police not to harass the petitioner unnecessarily.

5. With the above said observations, this Criminal Original Petition stands disposed of.
