ORDER

The petitioner approached this Court for a direction to the respondents to give police protection for the life and limb of the petitioner and his family members based on the representation dated 06.06.2020 at the time of restoring the fencing erected by the petitioner in survey No.418/1A1 and S.No.412/1A2 of Ayyampalayam village, Manachanallur Taluk, Trichy District.

The learned counsel for the petitioner submits that the petitioner had purchased the above said property in survey No.418/1A1 and S.No.412/1A2 of Ayyampalayam village from one Dhanapackiyam W/o.V.Krishnasamy through a registered sale deed vide document No.3052/2018. On 23.05.2020, one Ravi and his wives Periyakkal and Lakshmi along with his relatives Chinnadurai, Thirupathi, Rajendran and 25 others trespassed into the petitioner's land property and damaged the fencing erected by the petitioner. The entire incident was photographed and along with the CCTV footage, a complaint has been lodged before the second respondent police on 24.05.2020 and the same has been registered in Cr.No.1065 0f 2020 for the offences under Sections 147, 148, 294(b), 448, 427, 506(ii), 289 and 270 IPC.

According to the learned counsel for the petitioner, one of the accused in Cr.No.1065 of 2020 is a notorious criminal who was involved in a murder case and therefore, he apprehends that if he attempts to restore fencing he would be attacked. Hence, the petitioner has approached this Court seeking police protection.

3. Heard, Mr.N.Anandkumar, learned counsel for the petitioner and Mr.K.K.Ramakrishnan, learned Additional Public Prosecutor, for the respondents.

4. The second respondent police have filed a status report stating that the present case is under investigation and after securing the remaining accused, complete the investigation and file a final report before the concerned jurisdictional magistrate as early as possible. According to the second respondent police, the investigation of the case in Cr.No.1065 of 2020 is also nearing completion and the remaining accused are yet to be arrested.

5. Since the respondent police is swiftly acting on the complaint of the petitioner and also registering the case in Cr.No.1065 of 2020 and also the investigation is nearing completion, no further orders need to be passed in this petition. Hence, this Criminal Original Petition is closed.
