Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus or any other, the petitioner representation dated 22.10.2020 and consequently direct the respondent to issue new and fresh three wheeler auto rickshaw permit in favour of the petitioner herein to be used for contract carriage purposes.

In all the Petitions For Petitioner : Mr.S.Parthasarathy For Respondents : Mr.K.S.Selva Ganesan Additional Government Pleader COMMON ORDER The petitioners have filed these writ petitions for a Mandamus to consider their representations by the 1st respondent/the Regional Transport Officer, Regional Transport Office, Madurai in respect of the applications filed in Form CCPA, namely, the applications for contract carriage permit under Rule 170 of the Tamil Nadu Motor Vehicles Rules, 1989.

2.These writ petitions are opposed by the learned counsel for the official respondent stating that the petitioners should have given proper representations before the 2nd respondent/Regional Transport Authority, namely, the District Collector and the applications in Form CCPA, but have wrongly been addressed to the 1st respondent/the Regional Transport Officer, Regional Transport Office, Madurai Regional Transport Authority, Madurai North, instead of the 2nd respondent herein, the District Collector, Madurai. 3.It is submitted that the representations pursuant to the applications also should have been filed by the petitioners only to the concerned jurisdictional transport authority, namely, the District Collector.

4.Considering the same, the 2nd respondent herein/the Regional Transport Authority, namely, the District Collector, Madurai, is directed to consider the petitioners' applications and dispose of the same on merits and in accordance with law, within a period of 6 weeks from the date of receipt of a copy of this order.
