Mr.P.Kottaichamy, Government Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. PRAYER : FOR ANTICIPATORY BAIL IN CRIME NO. 45 OF 2023 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- he petitioner / Accused No.2, who apprehends arrest at the hands of the respondent Police for the offence punishable under Sections 417, 468, 471, 420 and 120 (b) IPC in Crime No.45 of 2023, seeks anticipatory bail. 1/3

2. The case of the prosecution is that the husband of the petitioner is working as TTR in the Railway Department. It is alleged that the petitioner and her husband cheated several persons as if they will arrange job in the Railway Department and collected more than Rs.1 Crore from the victims. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner did not commit any offence as alleged by the prosecution and he would further submit that all the allegations are made only against the first accused. He would further submit that from the year 2019, the first accused and the petitioner were living separately and the first accused has also filed a Divorce petition against the petitioner in H.M.O.P.No.315 of 2013 before the Sub Court, Theni. Accordingly, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Criminal Side) appearing for the respondent Police would submit that the petitioner is working as a School Teacher. According to him, one previous case is pending against the petitioner, which is similar in nature. He would further submit that the petitioner and her husband collected huge amount from the innocent persons. Hence, he prays for dismissal of this petition.

5. Considering the serious allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 2/3
