Petition filed under Article 226 of the Constitution of India for the issuance of Writ of Mandamus, directing the respondents 5 and 6 to consider the petitioner's representation dated 20.06.2015 and consequently direct the respondents to permit the petitioner to conduct the festival namely Horse taking Ceremony "Puravi Eduppu" to be conducted on 30.06.3015 and 01.07.2015 and give adequate police protection.

ORDER

This writ petition has been filed seeking for the issuance of Writ of Mandamus, directing the respondents 5 and 6 to consider the petitioner's representation dated 20.06.2015 and consequently direct the respondents to permit the petitioner to conduct the festival namely Horse taking Ceremony "Puravi Eduppu" to be conducted on 30.06.3015 and 01.07.2015 and give adequate police protection. https://hcservices.ecourts.gov.in/hcservices/

2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.

3.Learned counsel for the petitioner would submit that there was a Peace Committee Meeting held and in pursuant to the same, the opposite groups conducted the festival on 11.06.2015 and 12.06.2015 of this month. Therefore, the same cannot be objected to conduct the programme by the respondent.

4.The learned Additional Government Pleader appearing for the respondents, on instructions, would submit "Puravi Eduppu" and Kalari are prohibited. He further submitted that if permission is granted, the law and order problem would arise and there is no difficulty for giving permission to conduct the festival and not for Kalari. 5.The petitioner cannot claim as a matter of right that he should conduct the festival. If the conduct of festival creates law and order problem, such festival cannot be claimed to be conducted as a matter of right.

6.In view of the above, the respondents are directed to give permission to the petitioner to conduct the festival without indulging in "puravi Eduppu" and Kalari. The petitioner will have to give an undertaking to the Inspector of Police that the petitioner and his group would not indulge in Puravi Eduppu and kalari. If the petitioner is not obeying the condition, the concerned respondent police is at liberty to take appropriate action in accordance with law.
