Side) for the petitioner and of Mr.T.SUGADEV, Advocate for the Respondent the court made the following order:- The respondent in this Criminal Miscellaneous Petition viz., Thiru.Gopi Jeganathan stands accused in Crime No.184 of 2017 on the file of the NIB-CID, Theni District. The contraband in quantity is 150 Kilograms of Kanja. During vacation sitting, bail has been granted in favour of the accused on 23.05.2018. The satisfaction in terms of Section 37 of NDPS Act has not been recorded. The grant of bail without recording the satisfaction in terms of NDPS Act, when commercial quantity is involved, is illegal. The bail granted to the respondent in CRL.O.P.(MD).No.8012 of 2018 dated 23.05.2018 is cancelled.
Accordingly, CRL.M.P.(MD).No.4215 of 2018 in CRL.O.P.(MD). No.8012 of 2018 stands allowed.
