PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the fourth respondent to furnish the copy of the re-investigation Final Report and other documents in C.C.No.198 of 2024 in Crime No.211 of 2022 to the petitioner on the file of the learned Judicial Magistrate Court, Thirumangalam.

ORDER

The present petition has been filed seeking a direction to the fourth respondent to furnish the copy of the re-investigation Final Report and other 1/5

documents in C.C.No.198 of 2024 in Crime No.211 of 2022 to the petitioner on the file of the learned Judicial Magistrate Court, Thirumangalam. 2.According to the learned counsel appearing for the petitioner, a charge sheet was laid as against him in C.C.No.198 of 2024, which was challenged by him under Section 482 of Cr.P.C., before this Court in Crl.O.P.(MD).No.11891 of 2024. This Court vide order dated 29.07.2024, disposed of the said petition with a direction to the Additional Superintendent of Police, Madurai, to withdraw the final report filed before the learned Judicial Magistrate, Thriumangalam, and to seek permission from the learned Judicial Magistrate, Thirumangalam, for further investigation. Pursuant to the same, the second respondent withdrew the case in C.C.No.198 of 2024 on 24.01.2025.

The learned Judicial Magistrate, Thirumangalam, accepted the same and the case was closed. Thereafter, the second respondent appointed the fourth respondent as the investigation officer for re-investigation of the case. Thereafter, the petitioner sent a representation to the respondents Police seeking to send a copy of the re-investigation final report. Since no action has been taken, the present petition has been filed.

3.The learned Additional Public Prosecutor appearing for the respondents Police 1 to 3 submitted that the final report has been withdrawn and after reinvestigation, a fresh final report has been filed before the learned Judicial Magistrate, Tirumangalam on 29.08.2025 through E.Filing No.LTN20220001577C202500514. However, so far, the same has not been taken on file.

4.In view of the above said facts, the third respondent is directed to ensure that the defects pointed out by the concerned trial Court are rectified and represented, so that the chargesheet is taken on file. Since the re-investigation has been completed and final report has already been filed before the concerned Court, no further orders are called for.
