Heard Mr.G.Prabhu Rajadurai, learned counsel for the petitioner and Mr.K.Cibichakaraborthy, learned Standing Counsel appearing for the respondents.

The petitioner who is working as Assistant Professor Level XII, has filed this Writ Petition seeking direction against the respondents to consider the candidature of the petitioner for promotion from the post of Assistant Professor (Stage III) to Associate Professor Stage IV under Career Advancement Scheme in pursuant to the notification dated 16.12.2022.

Mr.G.Prabhu Rajadurai, learned counsel for the petitioner submitted that the petitioner has complied the conditions for getting qualified to be promoted to the next level post of Associate Professor Stage IV. But his candidature has not been considered in view of his mistaken submission of the required proforma, wherein he has listed those research papers which he has published during the previous years.

4. Mr.K.Cibichakaraborthy, learned Standing Counsel submitted that the petitioner has not complied the essential requirement of promotion under the Career Advancement Scheme as per UGC Regulations of 2018, his candidature 2/5

has not been considered or he would further submit that the petitioner has submitted his revised proforma in view of his mistakes crept in his earlier proforma and hence the same shall not be considered as it was submitted beyond the cut off date.

5. It is claimed by the petitioner that he has due publication in accordance with guidelines and if the same is considered, he can be promoted to the next level of Associate Professor Stage IV. Since the process of approval is only through a scrutiny and selection in tune with the compliance of the essential requirement, the respondents shall consider the revised proforma submitted by the petitioner, scrutinize the same and place it before the Selection Committee, if the petitioner is found to be fitting himself in the eligibility criteria and pass appropriate orders.

6. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 02.04.2024 NCC:yes/no Index:yes/no Internet:yes/no Nsr 3/5
