O R D E R
The petitioner seeks the relief of issuance of a Writ of Mandamus, to dispose of the petitioner's application for survey dated 11.03.2025.
2.Heard the learned Counsel for the petitioner and Mrs.S.Jeyapriya, learned Government Advocate appearing for the respondents.
3.The case of the petitioner is that the petitioner along with four others are in absolute possession and enjoyment of an extent of 1 acre 12 cents comprising in R.S.No. 5/3A2, 5/3A3, 5/3A4, 5/3B1, 5/3B2, 5/3B3, 5/3C and 5/3D of Managiri Village, Madurai North Taluk, Madurai District. However, civil suit in O.S.No.386 of 2008, came to be filed by the vendors of the petitioner and they filed a suit against 36 defendants including the petitioner and in order to establish the fact that the petitioner's property is not covered by 2/5
disputed property and his title deed and he is in the occupation and in possession of the petitioner, the petitioner has sought for the survey. The application has been filed only on 11.03.2025. 4.Considering the said position, the second respondent with the assistance of the third respondent shall conduct survey based on the petitioner's application dated 11.03.2025, within a period of twelve [12] weeks from the date of receipt of a copy of this order. 5.Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs.
