To set aside the judgment and conviction dated 13.03.2019 by the learned V Additional District and Sessions Judge(FAC), Madurai in Sessions Case No.103 of 2014 and acquit the Appellant. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.M.KARTHIKEYAVENKITACHALAPATHY, Advocate for the petitioner and of Mr.S.RAVI, Standing Counsel for Government on behalf of the Respondent, the court made the following order:- (Order of the Court was made by K.KALYANASUNDARAM.,J) This Petition has been filed by the Petitioner seeking for relaxation of the condition imposed by this Court in Crl.M.P(MD) No.3875 of 2020 in Crl.A(MD)No.156 of 2019, dated 27.08.2020 in connection with S.C.NO.103 of 2014, on the file of the learned V Additional District and Sessions Judge, Madurai. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.3686 of 2021 2.While granting Suspension of Sentence, the Petitioner was directed to appear before the Committal Court on the first working day of first and third week of every English Calendar month until further orders.
3.It is represented by the learned counsel for the Petitioner as well as the learned Standing Counsel appearing for the State Government/State that the Petitioner has complied with the condition from 14.09.2020 to 3.5.2021. Subsequently, in view of the lock down imposed by the Government, condition could not be complied with. Hence this Court is inclined to modify the condition to the effect that the Petitioner shall appear before the Committal Court on the first working day of every English Calendar month until further orders.
4.This Petition is ordered accordingly.
