Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 397 IPC, in Crime No.659 of 2016, on the file of the respondent police, seeks anticipatory bail.

2. The Case of the prosecution is that the petitioner and others restrained, the defacto complainant and attacked him and also robbed gold chain and gold ring weighing 3 sovereigns and Rs.1000 cash from the defacto complainant.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.

4. The learned Government Advocate (Criminal Side) submitted that the petitioner is arrayed as A3 and the petitioner/A3 along with A1 and A2 had snatched gold ornaments of the defacto complainant. This the second anticipatory bail application and the first application was dismissed. A1 was already detained in Goondas Act and A2 was arrested and released on bail. https://hcservices.ecourts.gov.in/hcservices/ 5.Considering the facts and circumstances of the case and also considering the change of circumstances as represented by the

learned Government Advocate (Criminal Side) and upon considering the overt act upon the petitioner/A3, I am inclined to grant anticipatory bail to the petitioner with the following condition. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Ramanathapuram, within a period of 10 days from the date on which the order copy made ready, and on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10 a.m. until further orders.
