Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Section 392 of IPC in Crime No.213 of 2018 seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and three unknown persons stopped the de-facto complainant and looted cash of Rs.5,000/- and mobile phone of the de-facto complainant and fled away from the scene of occurrence. He further submitted that the defacto complainant call for the help from his friend. Thereafter, the de-facto complainant and his friend chased the 1st accused and handed over the respondent police. Hence, this case is filed.

3. The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case.

4. The learned Government Advocate (Criminal side) submitted that the property has been recovered.

5. Considering the facts and circumstances of the case and taking note of the fact that the property has been recovered, this Court is inclined to grant the relief of anticipatory bail to the petitioner.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate concerned within a period of 10 days from the date of receipt of a copy of this order, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Melur, Madurai District, or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioner shall appear before the Court concerned daily twice at 10.30 a.m and 5.00 p.m until further orders.
