Respondent Prayer: This Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to subdivide and issue separate patta in favour of the petitioner in respect of Survey No.408 /3 A1 for an extent of 1 Acre 80 cents, which is situated at Kombaipatti Village, Dindigul East Taluk, Dindigul District, on the basis of the petitioner's representation dated 18.02.2021.

ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus, directing the respondents to consider the representation made by the petitioner on 18.02.2021, wherein, the petitioner has sought for a survey, subdivision and issuance of a patta in his name with respect to the subject property.

2. The case of the petitioner is that he purchased the subject property by virtue of a registered sale deed, dated 02.11.2020. According to the petitioner, he is in possession and enjoyment of the same and he has also paid necessary tax to the concerned Authorities,

3. The further case of the petitioner that there was a larger extent of property in Survey No.408 / 3A and the petitioner has purchased only an extent of 1 Acre and 80 cents. The petitioner, therefore, made an application before the respondent for survey, subdivision and issuance of patta in his name with respect to the property that was purchased by the petitioner. Since the same was not considered, the present Writ Petition has been filed before this Court seeking for appropriate directions. https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. Heard Mr.K.Arunraj, learned counsel appearing on behalf of the petitioner and Mr.M.Muniasamy, learned Additional Government Pleader appearing on behalf of the respondent.

5. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the respondent to consider the representation made by the petitioner on 18.02.2021, on its own merits and in accordance with law and pass appropriate orders within a period of twelve (12) weeks from the date of receipt of a copy of this order. If there are any other interested parties claiming right over the subject property, they shall also be issued with notice and an opportunity shall also be given to them.

6. The petitioner is directed to make a fresh representation to the respondent along with all the relevant documents and also a copy of this order.

7. This Writ Petition stands disposed of with the above directions. No costs.
