PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C., to relax the condition to report and sign before the respondent on 1st and 15th of every Month at 10 a.m., imposed by the learned Additional Chief Judicial Magistrate, Madurai in Cr.M.P.No.1240/16, dated 16.12.2016.

ORDER

This Criminal Original Petition is filed under Section 482 of Cr.P.C., to relax the bail condition imposed by the learned Additional Chief Judicial Magistrate, Madurai in Cr.M.P.No.1240 of 2016 dated 16.12.2016.

2. Heard Mr.M.Seenisulthan, learned counsel appearing for the petitioners and Mr.C.Arul Vadivel @ Sekar, learned Special Public Prosecutor appearing for the respondent.

3. The learned counsel for the petitioners submitted that the petitioners, who were arrested for the offences punishable under Section 135(c)r/w 135(1)(c) of the Customs Act,1962, were granted bail by the learned Additional Chief Judicial Magistrate, Madurai, in Crl.M.P.Nos.1043, 1093 & 1121 of 2016, dated 27.10.2016, with condition to report before the respondent Police daily at 10 a.m., until further orders. https://hcservices.ecourts.gov.in/hcservices/

Thereafter the condition was modified in Cr.M.P.No.1166 of 2016, dated 17.11.2016, as to report before the respondent Police once in a week i.e., Every Monday, which is further modified in Cr.M.P.No.1240 of 2016, dated 16.12.2016, as to report before the respondent Police once in fifteen days.

4. The learned Special Public Prosecutor submitted that investigation in this case is completed and the presence of the accused/petitioners is no more required for investigation.

5. Recording the same, the earlier condition imposed on the petitioners is relaxed and the petitioners shall report before the Investigating Officer as and when required for interrogation. This petition is ordered accordingly.
