Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as A-1, in Crime No.198 of 2016 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 420, 465, 468, 471 of IPC r/w 12(1)(b) of Indian Passport Act, 1968 and hence, seeks anticipatory bail. 2.The learned counsel appearing for the petitioner states that earlier anticipatory bail filed by the petitioner in Crl.O.P.No.
24121 of 2016 was dismissed stating that investigation is still pending and now the investigation was over and there is a change in circumstances, this petition has been filed. 3.The learned Government Advocate (Crl.side) appearing for the respondent states that totally there are three named and four unnamed accused in this case. The accused No.2 was granted bail by the Sessions Court on 08.01.2017 and accused No.3 was granted anticipatory bail by this Court in Crl.O.P(MD)No.23657 of 2016, dated 19.12.2016. A4 to A7 were arrested and released on bail by the concerned Judicial Magistrate. Investigation was over in this case and the charge-sheet is yet to be filed.

considering the change of circumstances in this case stating that investigation was over and charge sheet is yet to be filed, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Manapparai and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m., until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. 5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
