PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the 2nd respondent in Ref.No. 010600/CRS-97/10/2023 dated 09.01.2024 and consequently direct the 2nd respondent to disburse the medical reimbursement claim amount to the petitioner within a stipulated time as fixed by this Court. ORDER
The petitioner has filed this writ petition seeking Writ of Certiorarified Mandamus to quash the impugned order issued by the 2nd respondent dated 09.01.2024 and consequently direct the 2nd respondent to disburse the medical reimbursement claim amount to the petitioner within a stipulated time as fixed by this Court.
2. Heard Mr.C.Jeya Prakash, learned counsel appearing for the petitioner and Mr.J.Ashok, learned Additional Government Pleader appearing for the 2/6
respondents 1, 3 and 4 and Mr.S.Shajahan, learned Standing Counsel appearing for the second respondent.
3. The petitioner filed this writ petition challenging the order of the second respondent dated 09.01.2024 wherein it is stated that the line of medical management given to the petitioner is not covered under the Tamilnadu Health Insurance Scheme. Even in the said order itself, it has been specifically stated that if the petitioner has got any grievance, he can place the matter before the District Level Empowered Committee. However, the petitioner has not chosen to prefer any appeal before the District Level Empower Committee.

Mr.C.Jeya Prakash, learned counsel appearing for the petitioner submitted that the petitioner had undergone surgery for Hernia and it is covered under the New Health Insurance Scheme issued vide G.O.Ms.No.160 Finance (Salaries) Department dated 29.06.2021. The petitioner's plea is that the treatment undergone by him has been squarely covered under the scheme. Hence, he seeks indulgence of this Court.
5. Since the petitioner has an appeal remedy before the District Level Empowered Committee, this Court cannot give any direction in the meantime. 3/6
Hence, the petitioner is at liberty to approach the District Level Empowered Committee and make all his contentions in the appeal and to work out his remedy in the manner known to law.
