RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to Suspend the Sentence of imprisonment in the judgment made in Spl.S.C.No.5/2021 on the file of the Additional Sessions Judge Fast Track Mahila Court Karur Dt 12.8.2022 convicting the petitioer appellant for an offences under Section 366 IPC and sentenced to undergo Rigorous imprisonment for 20 years and pay fine Rs.1000/- in default to undergo simple imprisonment for 1 year for the offense under section 6 of POCSO Act and sentences are ordered to run concurrently and enlarge the petitioner/appellant on bail, pending disposal of the above Criminal Appeal. Prayer in Crl.A.(MD).No.348 of 2023:

To call for the records pertaining to the judgment in Sp.S.C.No.5 of 2021 on the file of the Additional Sessions Judge Fast Track Mahila Court, Karur vide Judgment dated 12.08.2022 by convicting the appellant under section 366 IPC and section 6 of POCSO Act 2012 and sentenced to undergo rigorous imprisonment for 10 years and 1/3

to pay a fine of Rs.1000/-, in default to undergo simple imprisonment for one year for the offense under section 366 of IPC and sentenced to undergo Rigorous imprisonment for 20 years and pay fine Rs.1000/- in default to undergo S.I for one year for the offense under section 6 of POCSO Act and set aside the same. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.GOKUL RAJ S, Advocate for the petitioner and of M/S.M.MUTHUMANIKKAM, Government Advocate(Crl.side) on behalf of the Respondent, the court made the following order:- Today, when the matter is taken up for hearing, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this Criminal Miscellaneous Petition and he has also made an endorsement to that effect.
