O R D E R

This petition has been filed seeking to direct the respondents to survey and peg mark the petitioner's Natham House Site of 0.01.00 Are, located in Survey No.170/17 in Sornakkadu Village, Peravurani Taluk, Thanjavur District and furnish the Survey Report with FMB as per Tamil Nadu GEO land record, within a time limit to be fixed by this Court.

2. The learned counsel for the petitioner submitted that the petitioner was granted Natham land measuring 2.27 cents, and a patta was issued in the name of the petitioner's husband on 28.11.2023. The learned counsel further stated that, during the survey of the neighbouring property, a dispute arose. Consequently, the Revenue Authorities advised the petitioner to have his property 2/6

surveyed independently. Accordingly, the petitioner submitted an application and paid the requisite fees.

3. Heard the learned Government Advocate appearing for the respondents.

4. Considering the facts and circumstances of the case, this Court directs the first respondent to conduct the survey with the assistance of the second respondent, after issuing notice to the petitioner as well as the petitioner's neighbours. If necessary, the jurisdictional police shall provide police protection to ensure that the survey of the land is conducted without any hindrance. The Court is also directing the Official respondents to adhere to the following Standard Operating Procedures:

a. The Official respondent shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

b.After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.
