PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of Certiorari, calling for the records pertaining to the pursuant to the impugned E-Auction sale notice issued by the respondent in Proceeding S.No. 02/43, dated 18.02.2023 and quash the same as illegal and arbitrary. [Order of the Court was made by The Hon'ble CHIEF JUSTICE] Counsel for petitioner states petitioner has not paid a sum of Rs. 5,00,000/- (Rupees Five Lakhs only) as directed by this Court.
2. In view thereof, Writ Petition is dismissed with cost. Petitioner shall pay a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) to respondent within a period of two weeks from today. If the amount is not paid,
the amount may also be added to the outstanding to the Bank and the Bank may charge interest also on the said amount. Consequently, the interim application is closed.
