Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the 1st respondent to direct the 2nd respondent not to interfere in the civil dispute that has been seized in O.S.No.108 of 2025 on the file of the Principal Sub Court, Pattukottai by directing the respondents no.3 to 5 to work out their remedy in the above suit and other reliefs, within the period as stipulated by this Court. 1/4

ORDER
This Criminal Original Petition has been filed by the petitioner to direct the 2nd respondent not to interfere in the civil dispute.
2. According to the petitioner, the property in S.No.134/10B2 to an extent of 12.27 cents situated at Uchiyaviduthi, Thiruvonom Taluk, Thanjavur District belongs to the petitioner. While so, the respondent police and the private respondents no.3 to 5 are causing trouble to the petitioner and a civil suit is also pending in O.S.No.108 of 20 and the private respondents are interfering with the petitioner's enjoyment. Now the private respondents are attempting to construct a building in the petitioner's land with the support of the 2nd respondent police. Hence this petition.
3. The learned Government Advocate (Criminal Side) appearing for the respondents no. 1 and 2 would submit that the allegations levelled against the 2nd respondent are false and the petitioner only lodged a complaint and the same was assigned C.S.R.No.60 of 2025. Thereafter, the petitioner has filed this petition and the 2nd respondent has no way interfered 2/4
with the civil dispute.
4. Considering the prayer sought for in this petition, this Court without even issuing notice to the respondents no. 3 to 4 inclined to pass orders.
5. According to the petitioner, the 2nd respondent has interfered with the civil dispute and the same is denied by the 2nd respondent. Per contra, the petitioner only lodged the complaint and the same is under enquiry in C.S.R.No.60 of 2025. In view of the same, recording the above said submissions of the 2nd respondent, this criminal original petition is closed. 28.03.2025 NCC : Yes / No Index : Yes / No Internet : Yes Mac 3/4
