Prayer: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent to accord police protection to the petitioner and her three daughters, namely, Anuja, Nithya and Krishnaveni residing at No.4/280, Navasakthi Nagar, Kuthapanchan Village, Ambai Road, Alankulam, Tenkasi District.

ORDER

The present petition is filed seeking a direction to the respondent to give police protection to the petitioner and her family members.

2.The grievance of the petitioner is that one Yasuraja is continuously engaged in making trouble to the petitioner, who is living alone with her children. Her husband also abandoned her. In respect of the trouble made by the said Yasuraja, she has given a complaint before the respondent police. But there was no action taken by the respondent police. Hence, the petitioner filed the present petition before this Court.

3.Heard the learned counsel on either side.

4.The learned Additional Public Prosecutor for the respondent, on instructions, would submit that based on the complaint given by the petitioner, though an enquiry was conducted by the respondent police in CSR.No.139 of 2021, she did not appear for enquiry and it was closed on 09.04.2021.

Crl.O.P.(MD)No.5632 of 2021 5.According to the learned counsel for the petitioner, it appears that there is some miscommunication between the petitioner and the respondent and so did not appear before the concerned officer for enquiry. Now, she is ready to co-operate for the enquiry.

6.In view of the above, the petitioner shall make a fresh representation to the respondent police within a period of fifteen days from the date of receipt of a copy of this order. On such representation being made, the respondent shall consider the same on merits after enquiring all persons concerned and pass appropriate orders and the petitioner shall co-operate for the enquiry. 7.With the above direction, the Criminal Original Petition is disposed of.
