Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, forbearing the 3rd Respondent to allot tender work to the contractors by his proceedings in Na.Ka.No.Aa2/1926/2021, dated 14.02.2022 and consequently direct the 3rd Respondent permit the petitioner in participating further tender proceedings.

ORDER

This writ petition has been filed for a Mandamus, to forbear the 3rd Respondent from allotting tender work to the contractors by his proceedings in Na.Ka.No.Aa2/1926/2021, dated 14.02.2022 and consequently direct the 3rd Respondent to permit the petitioner in participating in further tender proceedings.

2.The main grievance of the petitioner in this writ petition is that he has not been allowed to participate in the tender called for by the respondents. The petitioner claims to be a Contractor, who has participated in various tenders called for by the respondents earlier.

W.P.(MD)No.6929 of 2022 3.Heard Mr.T.Selvakumaran, the learned counsel appearing for the petitioner, Mr.B.Saravanan, learned Additional Government Pleader, appearing for the respondents 1 and 2 and Mr.G.Sivaraja, learned Government Advocate, appearing for 3rd respondent. 4.The learned Additional Government Pleader, appearing for the respondents 1 and 2, on instructions would submit that there is no prohibition for the petitioner to participate in any tender called for by the respondents, if the petitioner satisfies the tender requirements.

5.The petitioner is therefore, permitted to participate in the future tenders called for by the respondents, if he satisfies the tender requirements.

6.In terms of the aforesaid statement, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
