COMMON ORDER These petitions are filed seeking a direction to the second respondent in both the petitions to complete the investigation in Crime Nos.505 of 2019 and 260 of 2021 and file the final report within the time stipulated by this Court.
2.The case of the prosecution is that there was a dispute between the husband and wife and sons. Hence, the petitioner/defacto complainant gave a complaint before the respondent police. Based on which, the respondent police registered a case in Crime Nos.505 of 2019 and 260 of 2021 against his wife and sons. Till date, the respondent police has not taken any steps and so, the petitioner filed the present petitions before this Court. 3.Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the respondents. 4.When a question was put to the learned counsel for the petitioner about willingness to settle the matter through mediation, it was submitted by him that HMOP is pending seeking divorce and there is no possibility of settlement at the present. 5.
The learned Additional Public Prosecutor for the respondents, on instructions, would submit that the investigation in Crime Nos.505 of 2019 and 260 of 2021, is underway. However, he seeks three months time to file a final report. 6.In the facts and circumstances of the case, there shall be a direction to the second respondent in both the cases, to complete the investigation in Crime Nos.505 of 2019 and 260 of 2021 and file a final report before the concerned Court within a period of three months from the date of receipt of a copy of this order. 7.With the above directions, these Criminal Original Petitions are disposed of.
