Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to call for the records relating to FIR in Crime No. 52 of 2022 dated 16.07.2022 on the file of the 1st respondent and quash the same as against the petitioner.

ORDER

This Criminal Original Petition has been filed by the petitioner to quash the F.I.R in Crime No. 52 of 2022 dated 16.07.2022 on the file of the first respondent.

2. The learned Government Advocate (Criminal Side) appearing for the first respondent would submit that already they completed the investigation and filed the final report before the learned Judicial Magistrate, Tirupattur and the same is pending for taking cognizance.

3. Since the prayer of the petitioner is to quash the F.I.R and the 1st respondent has filed the final report before the learned Judicial Magistrate, Tirupattur and even as per the F.I.R, there are some allegations to constitute the offences, it is for the petitioner to challenge the final report in the manner known to law, if he is aggrieved. In view of the same, the petitioner is at liberty to challenge the final report in the manner known to law, this criminal original petition is closed. Consequently, connected criminal miscellaneous petition is also closed.
