The learned Counsel for the Petitioner submitted that the Petitioner is arrayed as A2 in Crime No.41/2024 pending on the file of the Inspector of Police, Irukkangudi Police Station, Virudhunagar District, and the Petitioner had filed this Criminal Original Petition seeking direction against thelearned Sessions Judge, Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act Cases, Srivillipudur, to accept the surrender of the Petitioner and consider his bail application in Crime No.41/2024, pending before the second Respondent.

2. The learned Government Advocate (Criminal Side) appearing for the Respondents 1 and 2 would submit that the Petitioner and another accused are alleged to have issued notice to the encroachers in the temple place and used filthy language, which attract the provisions of SC/ST (Prevention of Atrocities) Act. Hence, the case was registered in Crime 2/5

No.41/2024 under the provisions of SC/ST (Prevention of Atrocities) Act, based on the complaint of the third Respondent with the second Respondent. He further submit that other accused in this case had filed a petition in Crl.O.P(MD)No.4552 of 2022, which was closed yesterday.
