2017-06-13Honourable Mrs Justice J. Nisha Banu2 pages

BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Tuesday, the Thirteenth day of June Two Thousand Seventeen PRESENT The Hon`ble Mrs.Justice J.NISHA BANU CRL OP(MD) No.7039 of 2017 C.SAHUL HAMEED ... PETITIONER/ACCUSED RANK NOT KNOWN Vs STATE REP.BY, THE INSPECTOR OF POLICE THIRUMAYAM POLICE STATION, PUDUKKOTTAI DISTRICT CRIME NO. NOT KNOWN OF 2017 ... RESPONDENT/COMPLAINANT For Petitioner : M/S.B.VINOTHKUMAR Advocate For Respondent : MR.A.RAMAR, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 and 406 of I.P.C in Crime No.Not Known of 2017 on the file of the respondent police, seeks anticipatory bail. 2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent/State.

3.The learned Additional Public Prosecutor on instructions would submit that no F.I.R is registered and no F.I.R and no enquiry petition is pending against the petitioner and the alleged threat of arrest is not true.

4.However, the learned counsel appearing for the petitioner submitted that the petitioner attended enquiry at the respondent police station for ten times and he was also beaten up by the respondent police and thereafter only, the petitioner has approached this Court seeking anticipatory bail. But, the respondent police now states that no enquiry is pending against the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5. It is a very unfortunate case where the petitioner has been treated in a very rude manner by the respondent police and today it

is reported that no F.I.R is registered and no F.I.R and no enquiry petition is pending against the petitioner.

I record my displeasure on the above act of the respondent police.

6. In the result, recording the said submission of the learned Additional Public Prosecutor, this Criminal Original Petition is dismissed.
