ORDER

The present petition has been filed for issuance of Writ of Mandamus directing the respondent police to conduct a detail enquiry based upon the complaints, dated 25.10.2024 and 19.12.2024 vide CSR No.922 of 2024.

2. According to the petitioner, he lodged a complaint as against one Fathima before the respondent. But the respondent assigned CSR No.922 of 2024 and thereafter, not taken any steps. Therefore, filed this petition to conduct enquiry based on the complaints of the petitioner.

3. The learned Additional Public Prosecutor appearing for the respondent would submit that the complaints of the petitioner were already considered and closed as money dispute pending between the parties.

4. In reply, the learned Counsel appearing for the petitioner would submit that no enquiry was conducted and no order of closure has been 2/5

furnished to the petitioner. Today, the learned Additional Public Prosecutor appearing for the respondent served the copy of the closure report to the petitioner.

Since the prayer of the petitioner is to consider the representation based on the complaints given by the petitioner and to take action, already the said complaints were considered and the same was closed as money dispute, it is for the petitioner to challenge the same in the manner known to law, if he is aggrieved.

6. In view of the same, this writ petition stands closed by preserving the liberty of the petitioner to challenge the closure report in the manner known to law. There shall be no order as to costs. 18.03.2025 NCC : Yes / No Index : Yes / No Internet : Yes BTR 3/5
